ASSUMPTION OF RISK; RELEASE; INDEMNIFICATION; AND HELMET STATEMENT (DOWNLOAD)
1. Assumption of Risk. I am enrolling to participate in the UA “BamaBike” program. I understand that riding a bicycle can involve significant risks, including risks from falls, traffic, automobiles, other bicyclists, pedestrians, crashes, failing to wear a helmet, and other hazards. I agree to take all reasonable steps to avoid risks, including following the traffic laws, but I understand that harm, including death or injury may still occur. I have been invited to view a program involving bicycle safety, linked to the BamaBike website. Knowing and understanding these risks, I agree to assume any and all risk of injury related to my use of the bicycle and my participation in BamaBike.
2. Release. In consideration of allowing my participation in BamaBike, I knowingly and voluntarily waive, release, exculpate, and discharge any and all claims for damages for personal injury, including death, which I may have, or may hereafter accrue to me or my heirs, assigns, or next of kin, foreseen or unforeseen, as a result of my participation in BamaBike and use of a bicycle. This is intended by me to discharge in advance and hold harmless The Board of Trustees of the University of Alabama, its trustees, officers, employees, and agents (hereinafter, collectively “UA”), from and against any and all claims, actions, suits, proceedings, damages, costs and expenses, including attorney’s fees and cost of litigation, and liabilities arising out of, connected with, or resulting from my participation in BamaBike and use of a bicycle, including medical expenses or other costs resulting from injury, sickness or death (hereinafter, collectively “Liabilities”).
3. Indemnification. I agree to indemnify and hold harmless the parties collectively referred to as UA from all Liabilities, as defined above.
4. Helmet Use is Encouraged! I have been advised that I should wear a certified bicycle helmet, which may assist in preventing head injuries, and have been encouraged to obtain and wear such a helmet. It is up to me secure and use a helmet. In the event that I choose not to wear such a helmet, I accept and assume the increased risk from not wearing such a helmet; and release and indemnify UA (as defined above), from all Liabilities (as defined above), related to my choice not to wear a helmet.
5. Acknowledgement. I acknowledge that I have read this document and that I am relying wholly upon my own judgment, belief, and knowledge of the risks of injury. As of the date of this document I am 19 years of age or older. In the event that I am under 19, this form has been signed by my parents/guardians, who warrant their full right to enter into same on my behalf, enter into all of the waivers, releases, exculpations and discharges contained herein; and acknowledge and assume all of the risks set out herein.
